These Terms and Conditions (“Terms”) govern your access to and use of the Canine’s Unleashed Inc. website, customer accounts, communications, online services, Pup Social, Private Suite features, camera views, and pet-care services.

By accessing our website, creating an account, making a reservation, using our online services, opting into communications, or purchasing or using services from Canine’s Unleashed Inc. (“Canine’s Unleashed,” “we,” “us,” or “our”), you agree to these Terms.

  1. ELIGIBILITY AND AUTHORITY

You must be at least 18 years old and legally capable of entering into an agreement to create an account, make a reservation, or authorize services.

By providing information concerning a pet, you represent that you are the pet’s lawful owner or are authorized by the lawful owner to make decisions, accept these Terms, and request services for that pet.

You are responsible for providing accurate, current, and complete information.

  1. RELATIONSHIP TO OTHER AGREEMENTS

These Terms supplement, and do not replace, any service agreement, enrollment agreement, waiver, release, veterinary authorization, reservation policy, payment authorization, or other document you sign or accept in connection with our services.

If a specific signed service agreement conflicts with these general website Terms regarding pet-care services, the specific service agreement will control to the extent of that conflict.

  1. PET-CARE SERVICES

Canine’s Unleashed may provide daycare, boarding, Private Suite accommodations, grooming-related options, pet supervision, feeding, medication administration, customer updates, and other services described on our website or during booking.

Service availability, hours, features, staffing, pricing, capacity, and eligibility requirements may change.

We may refuse, restrict, modify, suspend, or end services when reasonably necessary for the health, safety, behavior, comfort, or welfare of any pet, customer, employee, visitor, or other person.

  1. PET INFORMATION AND CUSTOMER RESPONSIBILITIES

Customers must provide accurate and complete information concerning their pet, including:

• Vaccination status
• Health conditions
• Allergies
• Medications
• Feeding instructions
• Behavioral history
• Aggression, anxiety, escape behavior, or bite history
• Mobility or special-care needs
• Emergency contacts
• Veterinarian information
• Any condition that could affect the pet’s safety or the safety of others

You must promptly notify Canine’s Unleashed of material changes.

Failure to disclose relevant information may result in the refusal or termination of services and may make the customer responsible for resulting costs or damages to the extent permitted by law and applicable agreements.

  1. VACCINATIONS, HEALTH, AND ELIGIBILITY

Pets must satisfy the health, vaccination, temperament, enrollment, and other requirements applicable to the requested service.

Canine’s Unleashed may request records or additional information and may deny or suspend participation if requirements are not satisfied.

Customers should not bring a pet that is experiencing a contagious illness, vomiting, diarrhea, coughing, unusual discharge, parasites, or another condition that may present a risk to other pets or people.

We may separate or remove a pet from group activities when reasonably necessary for safety or welfare.

  1. INHERENT RISKS OF PET CARE

Customers acknowledge that daycare, boarding, group play, transportation, handling, feeding, exercise, and interaction with other animals involve inherent and unpredictable risks.

These risks may include scratches, bites, falls, escape attempts, illness, communicable disease, allergic reactions, stress, behavioral incidents, property damage, injury, or death.

Canine’s Unleashed takes reasonable precautions but cannot eliminate every risk associated with animal behavior or group care.

Nothing in these Terms waives rights or responsibilities that cannot legally be waived. Any additional assumption-of-risk provisions or releases contained in a signed customer agreement remain in effect.

  1. RESERVATIONS, CAPACITY, AND SERVICE CHANGES

Reservations are subject to availability, capacity limitations, eligibility requirements, and confirmation.

Submitting a request does not guarantee a reservation until it has been accepted or confirmed through the applicable booking system or by Canine’s Unleashed.

We may adjust room assignments, playgroups, activities, schedules, or service arrangements when reasonably necessary for safety, care, operations, or animal welfare.

  1. PRICING, PAYMENTS, DEPOSITS, AND REFUNDS

Customers agree to pay all applicable prices, taxes, deposits, fees, add-ons, and authorized charges associated with requested services.

Prices and service offerings may change. The price applicable to a confirmed reservation will be governed by the booking information and policies presented at the time of reservation, except for subsequently authorized services, extensions, emergency expenses, or other permitted charges.

Cancellation, late-cancellation, no-show, early-pickup, late-pickup, deposit, credit, and refund policies are governed by the policies displayed or accepted during booking and any applicable service agreement.

Payment processing may be provided by a third-party processor. Use of a payment service may also be governed by that provider’s terms and privacy policy.

  1. FEEDING, MEDICATIONS, AND PERSONAL ITEMS

Customers are responsible for providing complete and accurate feeding and medication instructions and properly labeled items when required.

Canine’s Unleashed may decline to administer a medication or perform a care instruction that staff cannot safely or reasonably provide.

Personal belongings are provided at the customer’s risk. Canine’s Unleashed is not responsible for ordinary loss, damage, wear, contamination, or destruction of personal items to the fullest extent permitted by law.

Restrictions on food, bedding, toys, containers, or other property may vary according to the selected service and safety requirements.

  1. EMERGENCY CARE

If a pet appears ill, injured, distressed, or in need of urgent care, Canine’s Unleashed may attempt to contact the customer or emergency contact.

If timely contact cannot be made, or immediate action is reasonably necessary, the customer authorizes Canine’s Unleashed to obtain veterinary or emergency care consistent with the customer’s signed agreements and information on file.

The customer remains responsible for authorized veterinary, transportation, medication, emergency, and related expenses except where prohibited by law or otherwise stated in a written agreement.

  1. CUSTOMER ACCOUNTS AND SECURITY

Certain services may require an account, username, password, access code, or other credential.

You are responsible for:

• Keeping credentials confidential
• Using a strong and unique password
• Restricting account access to authorized persons
• Logging out of shared devices
• Promptly reporting suspected unauthorized access
• Maintaining accurate account information

You may not access another customer’s account, camera view, messages, photographs, records, or controls without authorization.

We may suspend, restrict, or terminate access when we reasonably believe an account is being misused, compromised, or used in violation of these Terms.

  1. PUP SOCIAL AND CUSTOMER FEATURES

Pup Social and related customer features may provide access to additional camera views, pet photographs, daily still images, messages, articles, facility updates, and other customer-only content.

Access may be limited to eligible or active customers. Features, content, and availability may change without notice.

You may not:

• Copy, download, record, scrape, republish, sell, redistribute, or commercially exploit protected customer content without written permission
• Attempt to identify, contact, or obtain information about other customers through the service
• Share another customer’s pet images or information without authorization
• Use the service to harass, threaten, impersonate, defame, or invade another person’s privacy
• Upload unlawful, infringing, harmful, deceptive, or malicious content
• Attempt to bypass access controls or security measures

  1. CAMERAS, PHOTOGRAPHS, AND VIDEO

Camera access is offered as a customer convenience and is not a guaranteed, continuous, real-time monitoring service.

Camera views may be delayed, interrupted, unavailable, repositioned, obscured, or disabled because of maintenance, internet service, equipment failure, privacy, safety, security, overnight schedules, facility operations, or other reasons.

Customers must not rely on a camera feed as a substitute for communication with staff, professional pet care, emergency services, or facility supervision.

Camera access is personal and limited to authorized users. Customers may not publicly broadcast, rebroadcast, record, publish, distribute, or commercially use camera footage without written permission.

Other pets, employees, or facility activities may appear in camera views. Users must respect the privacy of others.

Use of pet photographs or videos for advertising or promotional purposes will be governed by applicable consent, releases, customer agreements, and law.

  1. PRIVATE SUITE FEATURES AND REMOTE CONTROLS

Private Suite services may include customer-accessible features such as camera views, television controls, treat or bone dispensers, messages, audio features, feeding options, activity selections, or other connected equipment.

These features are conveniences and may be delayed, interrupted, restricted, or unavailable because of equipment, software, internet, safety, maintenance, supply, or operational conditions.

Customer commands may be reviewed, delayed, modified, declined, or disabled when reasonably necessary for pet safety, health, dietary restrictions, staff instructions, security, or facility operations.

Customers must use controls responsibly and only for their assigned pet and room. Customers may not attempt to operate another room, bypass restrictions, repeatedly activate equipment, reverse engineer the system, or interfere with hardware, software, networks, or other users.

Connected features do not replace staff supervision or professional judgment.

  1. ACCEPTABLE USE OF THE WEBSITE AND SYSTEMS

You agree not to:

• Use the website or services for unlawful, fraudulent, abusive, or harmful purposes
• Attempt unauthorized access to accounts, servers, cameras, controls, databases, devices, or networks
• Introduce malware, malicious code, automated attacks, or disruptive traffic
• Probe, scan, test, defeat, or bypass security measures without written authorization
• Scrape, harvest, or collect data using automated means
• Reverse engineer, decompile, copy, imitate, or reproduce protected software or systems except where such a restriction is prohibited by law
• Interfere with the operation of the website or services
• Misrepresent your identity or authority
• Use information obtained through the services to violate another person’s privacy or rights

  1. INTELLECTUAL PROPERTY

The website, CuSuite Connect system, Pup Social features, software, code, databases, designs, interfaces, text, graphics, logos, photographs, videos, documentation, names, and other content are owned by or licensed to Canine’s Unleashed and are protected by applicable intellectual-property laws.

Canine’s Unleashed grants users a limited, revocable, nonexclusive, nontransferable right to access authorized services for personal, noncommercial use.

No ownership rights are transferred to users.

“Canine’s Unleashed,” “CuSuite Connect,” associated logos, and other branding may not be copied or used without written permission.

  1. CUSTOMER CONTENT AND MESSAGES

If you submit messages, photographs, reviews, comments, instructions, or other content, you represent that you have the right to submit that content and that it does not violate law or another person’s rights.

You grant Canine’s Unleashed permission to store, process, display, and transmit submitted content as reasonably necessary to provide the requested service, maintain records, operate customer features, and comply with legal obligations.

This section does not grant Canine’s Unleashed permission to use customer content in advertising beyond permissions otherwise provided by law or a separate consent or release.

  1. TEXT MESSAGING PROGRAM

Program Name: Canine’s Unleashed Customer Messaging Program

Customers who provide a mobile telephone number and opt in through Moego or another approved consent method may receive service-related text messages from Canine’s Unleashed Inc.

Messages may include reservation confirmations, appointment reminders, check-in information, pickup reminders, pet-care updates, account notices, facility information, responses to customer inquiries, and other communications related to requested services.

By opting in, you authorize Canine’s Unleashed Inc. to send text messages to the mobile number you provided. Consent applies only to communications from Canine’s Unleashed Inc. and is not transferred to another business.

Consent to receive text messages is not a condition of purchasing goods or services.

Message frequency varies. Customers will typically receive no more than one message per month, but frequency may increase depending on reservations, appointments, pet-care services, operational updates, or customer-support activity.

Message and data rates may apply according to your wireless carrier and mobile-service plan.

To stop receiving messages, reply STOP. After replying STOP, you may receive one final message confirming that you have been unsubscribed.

Wireless carriers are not liable for delayed or undelivered messages.

Message delivery is subject to wireless-network availability and is not guaranteed.

Mobile opt-in information and text-messaging consent will not be sold or shared with third parties or affiliates for marketing or promotional purposes.

  1. EMAIL COMMUNICATIONS

Customers who authorize email communications may receive service-related messages and other communications they requested.

You may use an unsubscribe link, when available, or contact us to update communication preferences. We may continue sending necessary transactional, safety, reservation, or account-related messages where permitted by law.

  1. THIRD-PARTY SERVICES AND LINKS

Our website and systems may link to or integrate with third-party services, including Moego, Twilio, WordPress, Bluehost, payment processors, analytics providers, mapping services, camera-streaming services, and other technology providers.

We do not control third-party services and are not responsible for their independent content, availability, security, terms, or privacy practices.

Your use of a third-party service may be governed by that provider’s terms and privacy policy.

  1. WEBSITE AND SERVICE AVAILABILITY

We do not guarantee that the website, customer portal, cameras, messages, connected devices, or online features will be uninterrupted, error-free, secure, or continuously available.

We may modify, maintain, suspend, discontinue, or restrict a feature at any time for operational, safety, security, technical, or business reasons.

  1. INFORMATIONAL CONTENT

Website articles, dog news, facility information, and other content are provided for general informational purposes.

They are not a substitute for veterinary, medical, legal, financial, or other professional advice. Contact a qualified veterinarian concerning your pet’s health or medical needs.

  1. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the website, online systems, camera access, connected features, and informational content are provided “as is” and “as available.”

Canine’s Unleashed disclaims warranties that may legally be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

Nothing in these Terms excludes any warranty or protection that cannot legally be excluded.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Canine’s Unleashed and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the website, camera feeds, customer systems, connected features, or informational content.

Any limitation concerning pet-care services is also governed by the applicable signed service agreement, waiver, and California law.

Nothing in these Terms limits liability that cannot legally be limited.

  1. INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless Canine’s Unleashed Inc. and its owners, employees, and agents from third-party claims, losses, liabilities, damages, and reasonable costs arising from:

• Your violation of these Terms
• Your unlawful or unauthorized use of the website or systems
• Information or content you submit
• Your infringement of another person’s rights
• Your failure to provide accurate or material pet information
• Actions taken by a person using your account with your authorization or because you failed to protect your credentials

This section does not require indemnification for conduct for which indemnification is prohibited by law.

  1. SUSPENSION AND TERMINATION

We may suspend or terminate accounts, access, reservations, or services when reasonably necessary because of:

• Violation of these Terms or another agreement
• Nonpayment
• Safety or animal-welfare concerns
• Fraud, abuse, harassment, or unlawful activity
• Unauthorized access or security concerns
• Repeated misuse of customer systems or connected equipment
• Operational or legal requirements

Obligations that by their nature should survive termination will remain in effect.

  1. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

To the extent permitted by law, disputes relating to these Terms will be brought in a court of competent jurisdiction located in San Diego County, California.

This section does not prevent either party from pursuing rights or remedies that cannot legally be restricted.

  1. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes in services, technology, operations, legal requirements, or business practices.

Updated Terms will be posted on this page with a revised effective date. Continued use of the website or online services after updated Terms become effective constitutes acceptance to the extent permitted by law.

Material changes affecting an existing reservation or service agreement will be handled according to the applicable agreement and law.

  1. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

  1. NO WAIVER

Failure to enforce a provision of these Terms does not waive our right to enforce it later.

  1. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without written permission from Canine’s Unleashed.

Canine’s Unleashed may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or operation of the business, subject to applicable law.

  1. ENTIRE AGREEMENT

These Terms, the Privacy Policy, and any applicable signed service agreements, waivers, authorizations, booking policies, or other customer agreements constitute the agreement governing the applicable subject matter.
